Legal notice
on switching data processing providers under the EU Data Act

Transfer procedure

Please notify us in writing of your intention to switch data processing service providers or to have your data deleted at least one month in advance (notice of termination). Once the notice period has expired, a transition period of 30 calendar days begins, during which you can export your data and during which we will support you and your new provider. Your data will then remain available for retrieval for a further 30 calendar days; after that, we will delete it completely and confirm the deletion to you. Further details are set out in Annex 3 (Changing providers under the EU Data Act) of the Terms of Use.

Export documentation

There are currently no harmonised standards or common specifications for the data processed in foxondo; exports are therefore carried out in CSV/XLSX format in accordance with Article 30(4) Data Act.

  1. Users can export the data they have entered. To do this, there is an ‘Export’ link available under each module heading.
Data can be exported in the following file formats: CSV, DOCX (Word) or XLSX (Excel).
The CSV file is structured as follows, with the first row containing the column headings:
    Firma,Modul,Frage-Nummer,Link zur Frage,Frage-Typ,Kontexte,Tags,Fragen-Überschrift,Satzanfang,Antwort im Textfeld,Antwort-Optionen,Ausgewählte Antwort-Optionen,Hochgeladene Dateien: Name,Hochgeladene Dateien: Link zur Datei,Hinzugefügter Link: Name,Hinzugefügter Link,Letzter Kommentar: Inhalt,Letzter Kommentar: Bearbeiter,Letzter Kommentar: Datum,Letzte Bearbeitung der Frage: Datum,Letzte Bearbeitung der Frage: Bearbeiter,Status der Frage
In CSV files (UTF-8), the fields are separated by commas and contain one record per line. Fields containing commas, line breaks or quotation marks are enclosed in quotation marks.
  1. During the transition period, the manufacturer can provide comments and activities as a CSV file upon request to support, containing the following columns:
    Aktivität,Nr,Bearbeiter,Datum,Kommentar,Status,Änderungsart,Inhalt alt,Inhalt neu
  1. Users with administrator rights can export uploaded files via Administration > Companies. The files are provided in a ZIP file containing folders organised by company/module/question number.
  2. Restrictions: User accounts and role assignments, system logs, structure of the questionnaire provided (insofar as it is protected by copyright), edit history beyond the activity log, system logs, internal identifiers and platform configuration data are not exported.

Pre-contractual information on fees

You can find the standard fees on the following page https://foxondo.com/en/prices-offer/
We do not charge any fees for the switch, data export or support during the switch. The standard fees will continue to apply during the ongoing transition period.

International Access

foxondos’s ICT infrastructure is subject to German law and European Union law. Data centres within the EU are used. Details of subcontractors can be found in the annex to the Data Processing Agreement.
Measures against unauthorised access from third countries: Processing, storage and backups take place exclusively within the EU. Data is encrypted during transmission (TLS). Administrative access is restricted to employees of foxondo and its service providers within the EU; it is role-based and logged. Our service providers are contractually obliged to process data only on our instructions within the EU and to inform us of any requests for access from public authorities. We assess requests from public authorities in third countries for their legal basis under EU and German law; without such a basis (such as a mutual legal assistance treaty), we do not disclose any data and inform the customer concerned, insofar as this is legally permissible.
